Abstract

In this volume of The Comparative Law Yearbook of International Business, Volume published under the auspices of the Center for Legal International Studies, lawyers from different jurisdictions examine developments relating not only to the framework for cross-border mediation, such as the Singapore Convention or inter-State disputes, but also to specific issues, such as mediator ethics and conflicts of interest, even exploring the neural science of conflict dynamics. One response has been the proliferation of mediation process between disputing parties and interactive negotiation assisted by a neutral third party using specialized negotiation and communication techniques. While mediation is not focused on the identification and application of legal rights and duties in the way that adjudication is, its success remains dependent on a legal framework that is still evolving in most jurisdictions and especially across borders.Among the broad spectrum of aspects of the subject in different jurisdiction, the book covers such issues and topics as the following: communication and conflict dynamics; enforcement of mediated settlement agreements; relevance of codes of conduct and ethical guidelines; mediation for settlement and prevention of inter-State conflicts; flexibility and quality in mediation training; and mediation culture and mediation practice.As a scrutiny of the updated developments in the legal fields by practitioners and experts, this yearbook helps readers gain insight into national and regional perspectives on the implementation and utility of international mediation.
